The New Orleans Tourism Marketing Corporation ("NOTMC") reserves the right to reject any entry for any reason whatsoever and is under no obligation to disclose the reason(s) for such a rejection. All use of information gathered by the New Orleans Tourism Marketing Corporation from the 2008 Art Lover’s Dream Vacation contest is subject to the New Orleans Tourism Marketing Corporation's Privacy Policy.
Contests are not available to employees or directors of the New Orleans Tourism Marketing Corporation, Prospect One, US Biennial, Café Degas, Zoë Bistro, and the W New Orleans Hotel, or their advertising agencies (and their immediate families and those living in their same household). All contests are only open to such residents who are also the registered subscriber of the e-mail account by which entry is made.
Winners will be chosen by random. Entry for contest award is limited to one per individual. Multiple entries will not increase your chance of winning and may be grounds for disqualification.
There will be no substitution of prizes, the award of the prize is personal to the winners and a winner may not transfer, sell, assign or give to any other person any rights or privileges obtained by the winner in this contest without express written consent from the New Orleans Tourism Marketing Corporation.
These rules require that the winners be in New Orleans for 3 consecutive nights sometime between November 1, 2008 and January 18, 2009. NOTMC will work with the winner to determine optimal dates within this time frame for prize redemption. The winner’s inability, for any reason or cause, to be in New Orleans on these dates voids the award of that prize and the winner will receive no portion of the prizes offered by New Orleans Tourism Marketing Corporation, its partners or the contest sponsors. The winner may not redeem this prize over the following blackout dates: November 8-11, Nov 29-Dec 1, Dec 31-Jan 2.
The New Orleans Tourism Marketing Corporation reserves the right to substitute a prize of comparable or greater value if an advertised prize is unavailable.
The winner will be responsible for all expenses not specifically provided for including, but not limited to, ground transportation, taxes, insurance, gratuities, as well as any and all incidentals. In all events, any transportation furnished, offered, or awarded shall be in accordance with the transportation policy of NOTMC, as established by NOTMC from time to time.
Before confirming travel plans, each contest winner must review, inquire about and comply with NOTMC's then current transportation policies (below) following notification of contest award.
NOTMC's current transportation policy is as follows:
NOTMC will provide two (2) coach class roundtrip airline tickets to New Orleans from any city in the continental US offering flight service to and from New Orleans - the total transportation expense to be paid by NOTMC shall not exceed the lesser of the actual transportation expense or the sum of $500 per person, per contest winner, unless otherwise specified.
Winner is solely responsible for transportation to his or her originating airport, regardless of his or her distance to the closest airport offering direct flight service to New Orleans.
NOTMC and all other sponsors shall not be responsible for any errors, omissions, accidents, or loss to person or property caused by any carrier, airline, transportation service or any other provider of services, foods, drinks, or goods, even in the event that NOTMC or any other sponsor furnishes, gives, awards, arranges for, authorizes, or makes any such goods, things, or services available for contest winners.
NOTMC is not responsible for the availability of air or ground transportation or for the cancellation or modification of any flight by any carrier.
All applicable federal, state and local laws shall apply. Taxes, if any, are the sole responsibility of the prize winner. All contests are VOID WHERE PROHIBITED BY LAW.
In case of any dispute, the decisions of the New Orleans Tourism Marketing Corporation are final. All entries become the property of the New Orleans Tourism Marketing Corporation.
Contest ends at 2:59 PM CT on October 1, 2008. One (1) Grand Prize Winner and three (3) alternates will be chosen in a random drawing from all eligible entries on or about October 1, 2008.
NOTMC will attempt to notify winners by telephone or e-mail on or around October 1, 2008. Failure to reach winners and have winners respond within one day (by approx. 3 PM CT July 2, 2008) to acknowledge acceptance of prize may result in the winner's entry being made ineligible. In such case, NOTMC will then contact the first alternate winner and start the process again. The winner consents to the use of his or her name and likeness, e-mail name, address, e-mail address, and/or photograph in any publicity, promotion, or advertising carried out by the New Orleans Tourism Marketing Corporation or its agencies.
Winner agrees to sign a sworn statement of eligibility and/or a further authorization/release, which confirms the rights granted to the New Orleans Tourism Marketing Corporation herein. Failure to return to NOTMC the properly executed authorization release form(s) by 5 PM CT on October 8, 2008 may result in prize forfeiture.
Prizes are not assignable, transferable or redeemable for cash. Odds of winning depend upon the number of entries received.
The New Orleans Tourism Marketing Corporation is not responsible for any late, lost, or misdirected entries, or computer, online, telephone, or technical malfunction that may occur for any reason.
